Your terms and conditions of use

The Regulations define the scope and terms of service online store provided at Companies Trade and Service Company "APEX" based in Przemysl, ul. Grunwaldzka 97, NIP 795-19-43-302, TAX 650 247 088, hereinafter referred to as the Seller, the person placing the order, hereinafter referred to as the Purchaser, who must be a natural person of full age having legal capacity, a legal person or an organizational unit without legal personality. 

  1. Sales are conducted in the form of a contract through the pages online store.
  2. Making purchases via websites Seller requires acceptance of cookies by your browser.

  3. Sales and order fulfillment is carried out only in the Poland.

  4. The prerequisite for the order is correct fulfillment of the contract by the Buyer through the Seller's website. 

  5. Placing an order by the Buyer constitutes acceptance of the Terms. 

  6. Seller reserves the right to refuse an order:
    a) if the information given by the Purchaser will be incomplete, incorrect, and inspiring a problem, or those which can not be confirmed at Seller's performance of the contract impossible, 
     b) if the person making the request does not comply with these Rules. 

  7. Seller shall within 48 hours of receipt of order confirm the order to the Buyer via the Internet or telephone. This time may be extended when it falls on public holidays

  8. Buyer may withdraw placed through the website Vendors order within 24 hours of its submission.

  9. After receiving confirmation of payment Seller is obliged to immediately send the parcels in Polish. In the case of temporary absence, the Seller reserves the right to extend the period for shipment of which will notify the Buyer in which case the buyer has the right to cancel the contract, and the entire amount will be refunded to the account of the Buyer.

  10. The right of withdrawal: 

    a) A buyer who has entered into a contract at a distance, may withdraw from it without giving any reason, within 14 days.
    b) Date of withdrawal shall expire after 14 days from the date on which the Buyer has entered into possession or a third party other than the carrier and indicated by the Purchaser entered into possession.
    c) To exercise the right of withdrawal, the Buyer must notify the Seller of its decision to withdraw from the contract by an unequivocal statement (for example, the letter sent by post, fax or email), contact details FHU APEX, 37-700 Przemysl, ul. Grunwald 97, tel. 16 670 92 92, contact form).
    d) The buyer may use the model withdrawal form, but it is not mandatory.
    e) To keep the term of withdrawal, it is enough to send the buyer information on exercising the right of withdrawal before the deadline to withdraw from the contract.

  11. Consequences of cancellation:

    a) In the event of cancellation by the Buyer, the Seller returns to the Buyer all payments received, including the cost of delivery of the goods (with the exception of the additional costs resulting from the Buyer of delivery other than the least expensive normal delivery offered by the Seller), promptly, and in any case not later than 14 days from the date on which the seller has been informed of the decision to exercise the right of withdrawal.
    b) The seller will refund the payment using the same payment methods that were used by the Buyer in the original transaction, unless the buyer expressly agreed otherwise; in each case the Buyer fails to pay any fees in connection with this phrase.
    c) The seller may withhold the reimbursement until receipt of the goods or the time to provide proof of her return, depending on which event occurs first.
    d) In the event of cancellation by the Buyer is obliged to return the favor, or by the Seller shall promptly, and in any event not later than 14 days from the date on which he informed the Seller to withdraw from the contract. The deadline is met if the buyer returns the item before the deadline of 14 days.
    e) In the event of cancellation by the Buyer shall bear the direct cost of returning it things.In the case of not receiving payment for the goods ordered within 7 days from the date of order Seller reserves the right to cancel the order.

  12. In the event of cancellation by the Buyer is responsible for only a reduction in the value of things resulting from the use of it in a different way than was necessary to establish the nature, characteristics and functioning of things.

  13. If you do not receive payment for ordered goods within 7 days from the date of order Seller reserves the right to cancel the order.

  14. The actual appearance of the goods offered may differ slightly from the images on the pictures posted on the site. Seller warrants that the goods offered are of the highest quality without defects, unless it is expressly stated in the description.

  15. Complaints regarding the purchased goods may be made by the Buyer through the website of the Seller, the postal operator or on the premises of the Seller.

  16. Complaints are handled within 14 days. In the case of the claim, the Buyer is sent a new copy in place of the non-compliant with the order. If the complaint is not upheld, Seller advertised merchandise returns at his own expense.

  17. Where it is found that the delivered goods is inconsistent with the order, the Buyer shall be entitled to replacement or ordered a new one. Return of goods ordered shall be for the account of the Seller, which cover the associated costs.

  18. The information presented on the online store of the Seller not constitute an offer within the meaning of the Civil Code.

  19. At the request of the Buyer issue an invoice.

  20. Shipping costs and payment terms are given at the time of the contract on the website of the Seller.

  21. In case of any ambiguity Buyer should contact the Seller.

  22. These rules apply from the date of 25-05-2018.

  23. In accordance with Art. 24 of the Act of August 29, 1997. Protection of Personal Data (Journal. Laws of 2002. No. 101, item. 926 as. Amended.) Trade and Service Company "APEX" based in Przemysl, ul. Grunwald 97, NIP 795-19-43-302, TAX 650 247 088 is an administrator you / and personal data. Personal data will be processed in order to conclude a sale and purchase of goods offered on the website Seller in effect the order placed by the Buyer through the Seller's website. 

  24. The transfer of data is voluntary, at any time the Customer is entitled to access to the data and to correct, delete or limit the processing. There is also the right to object to the processing of data, the right to transfer data, the right to withdraw consent for processing, as well as the right to lodge a complaint to the supervisory body. A request to delete data means resignation from further use of the website service and will result in immediate deletion of entrusted data.
